You know I wonder what happened..(rant a bit)

Post by Hearly »

I want to know when Personal Responsiblity went out the window and it became it's everyone elses fault but my own...

A good example of this is this article I just read...

http://www.msnbc.msn.com/id/12064988/

The article says that there is a class action lawsuit against Apple because that Ipods could cause Hearing loss when turned up...

Another one was back when Grand theft auto had that thing with the Nudity in it, a Grandmother was sueing them because she bought it for her 13 year old grandson and was "exposed" to the nudity...

I'm wondering when it happened, people looking to blame everything but there own stupidity....

Oh, it's always been your fault. Thats why I'm sueing you for posting this message which implies that I may be responsible for things I did.

But seriously -- this isn't anything new, it's just a continuation of the "(x) happened to me, I'm going to sue (insert list of corporations/government departments) for all they are worth" thing.

For the most part, I believe the situation has been created (and maintained) by ambulance-chasing lawyers looking for more money.

Examples:
Tripping over on an uneven bit of pavement and stubbing your toe, or scraping your arm. You bring it up with the council/whomever maintains that bit of pavement. If they don't do anything, then the responsible entity should be fined for it - and the money from the fine is used to pay for the necessary repairs. There's no need to be using up a courts time to deal with this kind of crap.

Kid A beats up on Kid B. The parents of Kid B are increasingly likely to sue the parents of Kid A for emotional distress, which is BS.
You call/visit the parents, if they do nothing then you call the cops. The cops go and scare the bejesus out of Kid A, infront of their parents. The kid learns quickly that beating up on kids is a bad way to go.

Or the New American way of doing things, Kid B brings a gun to school and shoots Kid A. Still kind of scary....

I think a major problem is that there is no penalty for losing a lawsuit filed in the USA. It would make more sense if the losing party had to pay the winning party's fees but the lawyers wouldn't like that.

Nah. Loser has to pay his normal stuff. The loser's lawyer, OTOH, has to pay all court costs plus the fee the other lawyer charged.

Either lawyer fees will drop to pennies an hour, or no lawyer will take a case they are not sure they'll win.

And if you don't bring a lawyer to the courtroom, you'll pay what the lawyer would have had to if you lose still.

On the other hand, we should also blame the judges for the stupid judgements that make all this silly suing possible. if judges started throwing out all these silly law suits, very soon nobody would be wasting any time on them.

What actually happened was that George Dubya Bush saw an Iraqi maths teacher carrying a geometry set, accused him of being a member of the notorious Al-gebra movement, and charged him with possessing weapons of maths instruction.
